2. Domain Ownership Certification
By using this Service, you certify and represent that:
- You are the owner of the website/domain you are submitting for analysis, OR
- You have explicit written authorization from the domain owner to conduct this audit, OR
- You are an authorized representative, employee, or agent of the organization that owns the domain
You acknowledge that:
- Submitting a domain you do not own or are not authorized to audit may violate applicable laws
- You are solely responsible for ensuring you have proper authorization
- SocialOnBrand has no obligation to verify domain ownership
- Any misrepresentation of ownership is your sole responsibility and liability
3. Disclaimer of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
SocialOnBrand expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Accuracy, reliability, or completeness of results
- Non-infringement
- That the Service will be uninterrupted or error-free
You acknowledge and agree that:
- GEO scores and analysis are for informational purposes only
- Results are generated through automated processes and may contain errors
- Scores may not reflect actual AI search visibility across all platforms
- Results should not be the sole basis for business decisions
- We do not guarantee any specific outcomes from implementing recommendations
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
SocialOnBrand, its officers, directors, employees, agents, and affiliates shall NOT be liable for any:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from your use or inability to use the Service
- Damages arising from any information obtained through the Service
- Damages arising from unauthorized access to your data
- Any other damages, regardless of legal theory
This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if SocialOnBrand has been advised of the possibility of such damage.
5. Indemnification
You agree to indemnify, defend, and hold harmless SocialOnBrand and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of any third party
- Your submission of domains you were not authorized to audit
- Any claim that your use of the Service caused damage to a third party
- Any information you provide to us
- Any actions taken based on the results or recommendations provided
6. Competitor Analysis Disclaimer
If you use this Service to analyze a competitor's website:
- You do so entirely at your own risk
- SocialOnBrand is not responsible for how you use competitor data
- You represent that such analysis is legal in your jurisdiction
- You agree not to use results for any unlawful purpose
- Any consequences arising from competitor analysis are solely your responsibility
SocialOnBrand does not encourage or endorse using this Service to analyze websites without proper authorization.
7. Data and Privacy
- We collect the email address and website URL you provide
- We may use this information to deliver results and for marketing purposes
- We do not sell your personal information to third parties

8. Intellectual Property

- Reports generated are for your internal use only and may not be resold

- Changes are effective immediately upon posting
- Continued use of the Service constitutes acceptance of modified Terms
10. Governing Law and Disputes
- These Terms are governed by the laws of the State of Texas, United States
- Any disputes shall be resolved in the courts located in Texas
- You waive any objections to jurisdiction and venue in such courts
- Any claim must be brought within one (1) year of the cause of action
11. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
12. Entire Agreement
These Terms constitute the entire agreement between you and SocialOnBrand regarding the Service and supersede all prior agreements.
